As per the constitution, a civil servant cannot be dismissed or removed by an authority subordinate to that by which he was appointed. Since, the Central government makes their appointment on the warrant of the President, they can’t be removed by anyone other than the President.

However, the all-India services are controlled jointly by the Central and state governments.

The ultimate control lies with the Central government while the immediate control is vested in the state governments.

Any disciplinary action (imposition of penalties or removal or reduction in rank) against these officers can only be taken by the Central government.

The Government of India celebrates April 21 every year as ‘Civil Services day’ as an occasion for the civil servants to rededicate themselves to the cause of citizen and renew their commitments to public service and excellence in work. This date is chosen to commemorate the day when first Home Minister of Independent India, Sardar Vallabhbhai Patel addressed the probationers of Administrative Services Officers in 1947 at Metcalf House, Delhi, he referred to civil servants as the ‘steel frame of India’. The first such function was held in Vigyan Bhawan, New Delhi 21 April 2006.

Article 309 empowers the Parliament and the state legislatures to regulate the recruitment and the conditions of service of the persons appointed to public services and posts under the Centre and the states, respectively.

Article 310 essentially conveys that civil servants of the Union hold office during the pleasure of the President, and those at the state at the pleasure of the Governor.

The members are drawn from both judicial and administrative streams appointed by the president.

With the amendment in Administrative Tribunals Act, 1985 in 2006, the members have been given the status of judges of High Courts.

Originally, appeals against the orders of the CAT could be made only in the Supreme Court and not in the high courts.

However, in the Chandra Kumar case (1997), the Supreme Court declared this restriction on the jurisdiction of the High Courts as unconstitutional, holding that judicial review is a part of the basic structure of the Constitution.

The CAT exercises original jurisdiction in relation to recruitment and all service matters of public servants covered by it. Its jurisdiction extends to the all-India services, the Central civil services, civil posts under the Centre and civilian employees of defence services. However, the members of the defence forces, officers and servants of the Supreme Court and the secretarial staff of the Parliament are not covered by it.
